Attention… Compulsory traffic insurance will now include compensation for depreciation in value…
According to the communiqué published in the Official Gazette by the Insurance and Private Pension Regulation and Supervision Authority (SEDDK), applications for Material Damage Coverage for vehicles involved in accidents will cover the cost of the damage and the depreciation in value of the vehicle.
The communiqué of the Insurance and Private Pension Regulation and Supervision Authority (SEDDK) titled “General Conditions Regarding Amendments to the General Conditions of Compulsory Motor Vehicle Liability Insurance” was published in the Official Gazette.
With this amendment, the definition of “permanent data storage medium” has been added to the general conditions. Short message, email, internet, mobile application, disk, CD, DVD, memory card, and systems established through the Insurance Information and Supervision Center or e-Government will be considered within this scope. According to the notification, the depreciation in value of a vehicle involved in an accident under the Material Damage Coverage will be determined by an insurance expert appointed by the SEDDK (Insurance and Damage Regulatory Authority) according to the procedures and principles determined by the SEDDK. This determination will take into account the vehicle’s make, age, model, level of use, damaged parts, past damage history, and the difference between the vehicle’s resale value before the accident and its resale value after repair. The insurance expert will also include their assessment of the depreciation amount in their report. Applications under this coverage will cover the cost of the damage to the vehicle and the depreciation in value.
The claimant who applies for vehicle damage will also be considered to have applied for depreciation compensation. The insurer will notify the claimant of the calculated depreciation amount in writing or via a permanent data storage medium no later than the business day following the date the final expert report is received. The Health Expenses Coverage will include all treatment expenses, including the cost of prosthetic organs, incurred to restore the third party to their former physical condition as a result of a traffic accident.
This coverage includes expenses incurred during the victim’s treatment from the start of treatment until they receive a permanent disability report, as well as ongoing caregiver expenses. Caregiver expenses arising from the start of treatment until the victim receives a permanent disability report, and ongoing caregiver expenses deemed medically necessary after the determination of the permanent disability rate, will be covered by insurance companies or the guarantee fund under the Health Expenses Coverage.
Temporary incapacity for work and permanent disability resulting from a traffic accident will be covered under the Injury Coverage. In this context, if the relevant institutions and organizations determine a causal link in the documents related to the traffic accident, the burden of proof to the contrary of this determination will rest with the insurance company. If the insurer applies for an appeal regarding the said report in accordance with the relevant legislation, the insurer will be obligated to cover the documented expenses incurred by the victim following the appeal under this coverage.
The amount of compensation will be determined based on the individual who sustained the disability. Loss of Support (Death) Coverage will include compensation determined according to the provisions of Law No. 6098 on torts, to cover the losses of those who have lost the support of a third party due to the death of the deceased. The deceased will be taken as the basis for determining the amount of compensation.
The communiqué will enter into force on July 1, 2026.
